Disputes can be settled out of court, at your convenience. Court can be very expensive, time consuming and stressful. When a dispute goes to court, you lose control and the court makes decisions for you. In mediation the parties in dispute create their outcome. Parties can always go to court later if a settlement is not reached in mediation. Disputants can use mediation for discovery; to get a clearer understanding of the issues on both sides. Discovery may prevent lengthy, costly and difficult litigation. Mediation can be used at any time with or without a lawyer. Kaua’i Mediation Works provides practical help in setting up a mediation and selecting a mediator. What does a mediation cost? Every mediation is unique. Most last about two hours. Some are complex and continue over multiple sessions. Typically each side pays $200 for a basic mediation session. Protracted mediations will be adjusted to an agreed upon hourly charge and parties in need can arrange a fee adjustment or be directed to a public agency.
